“The H-1B visa is an extension of a guest worker program set up by Congress in the late 1970s. Employers who can’t find qualified workers can use the visa to bring in temporary foreign workers looking to perform skilled positions.” Sounds pretty easy right? Nope, it’s not. There are three main components: interviews, visa processing, and paperwork.
The H1B visa is broken into three parts. First, interviews. This is where the employer and the prospective worker speak with each other in order to find out if the worker is a good fit for the job. If not, the worker is turned down. If the worker is hired on the spot, the employer gets to review the worker file. The employer then has to send a copy of this file to the Department of Labor for processing.
I am not sure what this is supposed to mean, but I feel like this is more than just a “yes, we have a problem.” It is a series of problems that were happening on the job.
The purpose of the h1b process is to ensure that the worker is paid and is not on any welfare because the worker is not entitled to the full salary. This is not something that the employer can go back and change, it is a way for the employer to be sure that the worker is going to be paid at the end of the job. The employer is required to make sure that the worker is paid through the check.
The employer can go back and change the check, but it’s not because of the worker’s lack of entitlement. It’s because the employer has to make sure that the worker is doing a job of the appropriate kind. If the employer is looking to change the check because he is not getting the full salary, then that could create the potential for the worker’s not being paid at the end of the job.
Another way to think about h1b is that it is like your “regular” job, except it is unpaid for a lot of the time. If you are working at a startup and you have to work a lot of overtime to get paid for your work, then you are probably not doing a good job.
The thing with h1b is that people are often not able to decide what “appropriate” means. What we are seeing the most is when a person goes on h1b because they cannot get along with their previous employer. If you look at the h1b part of the work visa, most companies will not allow you to work on your h1b until you are working at a company with a more stable business model.
H1b is often the wrong choice for a part-time job because it forces a person to take on more responsibilities than they are capable of. You can work on h1b part-time and still not be able to support yourself financially. What this means is that you will likely have to take a full-time job to support yourself with the h1b visa, which is a bad idea in most cases.
While working on the h1b, you will also be required to follow the standard health-and-safety guidelines of the company. In the end, part-time employment may not be right for you, but it is a decision that can be made with a lot of discretion.
While working part-time, you will have to go to a doctor regularly and be tested for diseases. Your employer may ask that you take out a loan, which can be done to cover medical bills. This is another bad idea. The h1b is probably a temporary visa, and the only thing you’ll be able to do with it is apply for an extension if you pass your health-and-safety test. This is also a bad idea.
